On May 3, 2023, the U.S. Food and Drug Administration (FDA) published a petition filed by the Environmental Defense Fund (EDF), the Center for Environmental Health (CEH), the Center for Food Safety (CFS), the Center for Science in the Public Interest (CSPI), and the Environmental Working Group (EWG). Proposed repeal of the provision allowing the use of titanium dioxide as a color additive in food - 21 CFR 73.575.
An overview of petitions
The petition was submitted to the FDA on April 14, 2023. The petitioner stated that the safety of titanium dioxide as a color additive no longer meets the safety standards in 21 CFR 70.3 (i), citing the European Food Safety Authority (EFSA ) "Safety Assessment of Titanium Dioxide as a Food Additive" published in May 2021 and other publications as evidence.
The report states that titanium dioxide nanoparticles may pose potential risks to human health. The European Commission announced a ban on the use of titanium dioxide as a food additive on January 14, 2022.
Scope of application
It should be noted that the bill proposed to be repealed by this petition is limited to color additive uses and does not cover other food contact uses (according to 21 CFR, titanium dioxide can also be used in adhesives, acrylic copolymer coatings, polymer coatings, cardboard and other fillers for various purposes).
Consultation
Comments, additional scientific data and other information related to the safety of titanium dioxide in food may be submitted to FDA by July 3, 2023. In addition, the FDA submitted a notice of color additive petition to the Sanitary and Phytosanitary Committee of the World Trade Organization on May 5, requesting input from the international community on the proposed titanium dioxide ban.
